Terms of Service

These terms govern your use of picarm.com and app.picarm.com and the editing services you order through them. By placing an order you agree to them.
1. Who we are
Picarm is operated by Picarm Ltd, a company registered in England & Wales. You can reach us at hello@picarm.com. In these terms “we”, “us” and “Picarm” mean Picarm Ltd, and “you” means the business placing the order.
2. Who these terms are for
Picarm is a service for businesses. By ordering you confirm you are acting for purposes relating to your trade, business or profession, and not as a consumer. Statutory consumer cancellation rights do not apply to business customers.
3. Your account
Access to the app is granted by approval. You are responsible for keeping your login details secure and for everything done through your account. Tell us promptly at hello@picarm.com if you think someone else has access to it.
You can price up a job in the editor without an account. Work done in that state is stored in your own browser, not by us, and we cannot recover it for you if you clear your browser data or switch device.
4. Placing an order
You select the services you want for each image and the app shows a running total. Your order is placed when you complete checkout and payment is authorised, and it is at that point that a contract forms between us.
The options you select for each image are the brief. Anything you add with the markup tool forms part of it. We edit to that brief, so it is worth being specific.
We may decline an order. If we do, we will tell you and refund anything you have paid for it.
5. Prices, tax and payment
Prices are per image and per service, and are shown in the editor before you check out. The total shown at checkout is the amount you pay.
Our prices are set in pounds sterling. Depending on where you are, prices may be displayed and charged in US dollars at a fixed conversion rate; the sterling price is the reference in either case.
Where we are required to collect sales tax or VAT, it is calculated and shown at checkout before you pay.
Payment is taken in full at checkout through Stripe, our payment processor. Stripe handles your card details directly and we never receive them. We may offer promotional discounts from time to time, subject to whatever conditions we state when we offer them.
6. Your images and who owns what
You keep ownership of your images. Uploading them to Picarm transfers nothing.
You grant us a limited licence to store, transmit and edit your images strictly for the purpose of providing the service you have ordered, including making them available to the editors and quality reviewers working on your order. That licence ends when we no longer need the images to provide or support the service.
We do not use your images to train AI models, and we will not use them to promote Picarm without your written permission.
You confirm that you own the images you upload or have the rights needed to have them edited, and that editing them will not infringe anyone else’s rights. You are responsible for clearing any rights in the people, products, brands or artwork appearing in them.
Edited images are yours. Once you have paid in full, all rights in the edited versions we deliver belong to you, with no restriction on how you use them.
7. Delivery, review and changes
We deliver finished files through the app, in the formats set out in your order.
Nothing is final until you approve it. You can review every image and request changes on any of them. We will re-edit to bring the work in line with the brief you ordered at no extra charge. Changes that go beyond that original brief, including new services or a changed specification, are new work and are priced as a new order.
If you neither approve an order nor request changes, we will remind you. After a reasonable period without a response we may treat the order as approved so that it can be closed.
8. Turnaround
We will work to any timescale we have agreed with you in writing. Absent that, turnaround times we quote are estimates rather than guarantees, and time is not of the essence.
9. Cancellation and refunds
Editing is bespoke work carried out specifically for you, so an order cannot be cancelled once editing has started.
If you tell us before editing begins, we will cancel and refund in full. If we cannot deliver work that meets the brief you ordered after a reasonable opportunity to correct it, we will refund the affected images. Refunds go back to the original payment method.
10. Acceptable use
You must not use Picarm to process images that are unlawful, that infringe someone else’s rights, that depict child sexual abuse or non-consensual sexual content, or that you intend to use to deceive or defraud. You must not attempt to disrupt, probe or gain unauthorised access to the service.
We may refuse or stop work on anything that breaches this section, and we may report unlawful material to the authorities.
11. Availability
We aim to keep the service running and available, but we do not guarantee it will be uninterrupted or error-free. We may suspend it for maintenance, or change or withdraw features. Where a change is significant and affects an order you have already placed, we will tell you.
12. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.
We are not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss.
Keep your own copies. You are responsible for retaining the original files you upload. We are not a backup service and we are not liable for loss of your originals.
13. Data protection
How we handle personal data is set out in our Privacy & Cookies notice.
14. Changes to these terms
We may update these terms. The version in force for your order is the one published when you placed it. If we make a material change we will update the date at the top of this page.
15. Ending the agreement
You can stop using Picarm at any time. We may suspend or close your account if you breach these terms or fail to pay. Ending the agreement does not affect orders already placed and paid for, or any rights and obligations that have already accrued.
16. Governing law
These terms and any dispute arising out of them are governed by the law of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
